1. Scope of Application

These Terms and Conditions (“T&C”) apply to all business relationships between 2BIM3 AI (“Provider”) and its clients (“Customer”) in connection with the creation, delivery, and provision of 3D BIM models based on submitted 2D plans.
Any terms or conditions of the Customer that deviate from or supplement these T&C shall not apply unless expressly approved in writing by the Provider.

2. Service Description

2BIM3.ai provides AI-assisted and manually verified creation of BIM models (e.g. Revit files) based on 2D plans (PDF, DWG, scanned drawings, etc.).
Delivery usually takes place within 24 hours after order confirmation but may vary depending on the project’s scope.
The delivered files are intended exclusively for professional use in design, visualization, or documentation workflows.

3. Formation of Contract

A binding contract is concluded only when the Provider confirms the Customer’s request in writing or by email, or issues an invoice.
Submitting files or inquiries (“Book a Demo”, “Request a Quote”) does not constitute a binding offer.

4. Prices and Payment Terms

All prices stated on the website are in euros (€) and exclude VAT unless otherwise specified.
Invoices are due within 14 days without deduction.
For larger projects, the Provider may request an advance or partial payment.

5. Copyright and Usage Rights

All BIM models and associated data created by the Provider are protected by copyright.
Upon full payment, the Customer receives a non-transferable, non-exclusive right of use for the agreed purposes.
Distribution, resale, or publication of the materials to third parties requires prior written consent from the Provider.

6. Delivery Times and Availability

The Provider endeavors to deliver within the stated 24-hour timeframe; however, this is not a binding guarantee unless explicitly confirmed in writing.
Delays due to force majeure, technical issues, or incomplete Customer data do not entitle the Customer to compensation.

7. Warranty and Liability

The Provider shall not be liable for damages resulting from the use of the delivered BIM models unless caused by intent or gross negligence.
No liability is assumed for indirect damages, loss of profit, or data loss.
The Customer is responsible for checking the delivered files for plausibility and suitability before further use.

8. Disclaimer of Liability

All information provided on this website is for general informational purposes only.
Despite careful content review, the Provider assumes no liability for the accuracy, completeness, or timeliness of the content.
The Provider accepts no responsibility for external links; their operators are solely responsible for their content.
The Provider shall not be liable for any material or immaterial damage arising from the use or non-use of the information provided, except in cases of proven intent or gross negligence.

9. Data Protection

Personal data is processed exclusively in accordance with the Privacy Policy.
The Provider commits to using such data solely for order processing and client communication.

10. Final Provisions

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Place of jurisdiction, where legally permissible, is the Provider’s registered office.
If any provision of these Terms is found invalid, the remaining provisions shall remain unaffected.
